Therefore, in practice, no Defendant, whoever they are, or whatever Governing body, should be treated any differently to the normal man or woman on the street. The plain fact is, that this works in theory but not in practice. Large conglomerates, Governments and regulatory bodies often use their size and unlimited resources in particular to finance and drain the life from a Claimant who is smaller than them. There is a term that I have heard many times and come to use now which is “Litigation Fatigue”. In a legal system where justice is supposed to come above and beyond all else, these methods we consider irreprehensible exist and are widely practiced. There are few firms who are willing to make a stand against these “Establishments” for fear of reprisals that they may, and often do, face. As a firm we have encountered many challenging circumstances such as this. We can only pre-warn our clients that they may need to be prepared for “long-haul” litigation. Separately we seek together with various funders to find a solution to the enduring financial struggles that the client will no doubt face whilst utilising other skill sets to manage such cases, and to attempt to settle through mediation. To this end, the claimants may come away disgruntled having signed a Confidentiality Agreement. with the institution that, quite simply, don’t want their dirty tactics, poor conduct, and in some cases, intentional misgivings made public.
