Finance Monthly Global Awards 2019 Edition

SOUTH AFRICA 71 Finance Monthly Global Awards 2019 www.finance-monthly.com FIDUCIARY LAWYER OF THE YEAR FIRM PROFILE First National Bank forms part of the FirstRand Group, one of the largest financial institutions in the Republic of South Africa, being listed on the JSE and the Namibian Stock Exchange, and provides banking, insurance and investment products and services to inter alia retail, commercial, corporate and the public-sector. FNB Fiduciary Advice forms part of the FirstRand Group and Anne joined the group in 2016, with a mandate by her direct superior, Chanel Kempff, to turn the Fiduciary Advice team into the captains of industry. We are a specialist team of legal professionals with well-honed skills, focussing on local and international corporate structuring, wealth preservation and seamless inter-generational transfer of wealth. Holistic succession and wealth preservation planning are some of our core advice themes. We are always looking for robust and bespoke client solutions and empower our clients by designing various tools and enablement solutions. Some of our solutions worth mentioning is that our team was responsible for creating a digital channel in the Virtual Fiduciary Advisory space. We also produced an easy to use ‘Trust Health Check’ review toolkit. Our team designed an Offshore Funding Calculation tool, setting out different funding options for clients. The team identified the need to educate clients and developed a training module for our next-gen client base, with the fun and immersive option of creating their own “avatars”, whilst learning about wealth preservation through role- play and practical scenarios. We take clients on a journey and empower them to understand the Fiduciary world. Seeing that an increasing number of South Africans have a global footprint, we arrange annual conferences with the South African Institute of Tax Practitioners, where a range of industry specialists present on topics spanning from diverse themes, such as the Global Exchange of Financial Information to the latest international tax changes. Most South Africans are avid digital citizens, and we prepared a guideline document for the frontline staff, on how to manage your digital footprint, as part of a comprehensive estate plan. Our team is fit for purpose, in a unique South African world, where we have the skills to provide custom-made advice and offer practical and inventive solutions. We address the unique planning requirements of Islamic clients and have created a bespoke offering based on Islamic law and principles. This offering is ground-breaking in the market due to the unique nature of the Trust Instrument and its requirements. As Anne’s current role demands a focused approach, she only looks after a core number of clients and is involved in charitable initiatives, which embrace FirstRand’s Philanthropy endeavours in the educational field, specifically early childhood development. Being a mother of two young children made her realise that a fine balancing act is required between professional and personal life and has made her a skilled time manager. AREAS OF EXPERTISE, INTER ALIA • Estate and Succession Planning • Fiduciary Advice & Cross-Border Estate Advice • Professional Trustee • Philanthropy Our team was mentioned in “The Chambers, Professional Advisers for HNW”, where they commented that “FNB enjoys a fine reputation for the wide range of services it offers to high net worth individuals and families”. ABOUT ANNE KLEIN From a young age, Anne knew that she wanted to be a lawyer and follow in her late father’s footsteps. With herself and three siblings studying law, one could expect some sibling rivalry and healthy competition along the way, thankfully, the legal fraternity caters for a wide variety of skills and personality types and the siblings all specialised in different legal fields. Anne is an attorney, notary and conveyancer and started her career with the Department of Justice. From commencing her career in the “typewriter age”, to immersing herself in the “always-on” culture, Anne can adapt to change. With a wide professional network and a diversity of skills, Anne was fortunate to serve articles at one of the oldest law firms and has worked at a “big four” international audit firm. She also worked for a multi-national Fiduciary Company and during her tenure, she acted as trustee and trusted adviser to some of the most prominent South African’ families.
